How Jehovah's Witnesses helped kill Prop 8

Mormons took a lot of abuse for helping pass Proposition 8 in California, where 52% of voters banned the right of gay couples to marry in 2008. But will anyone thank Jehovah's Witnesses for their role in getting the law declared unconstitutional?

One of the biggest outcries over Prop 8 was that the fundamental rights of a minority group could be taken away by popular vote — which isn't supposed to happen in America, land of the free.

Vaughn Walker, the federal judge who struck down Prop 8 this week, boldly said it "was premised on the belief that same-sex couples simply are not as good as opposite-sex couples." He also minced no words with the electorate: "That the majority of California voters supported Proposition 8 is irrelevant."

This is where Jehovah's Witnesses come in. On Page 116 of Judge Walker's ruling, he cites a 1943 Supreme Court case where the high court did a rare reversal of itself, acknowledging a mistake it made in a Jehovah's Witness case three years earlier. What happened between 1940 and 1943 to Jehovah's Witnesses gave Judge Walker in 2010 his most potent precedent to show that voter will does not trump the protection of minority rights.

A villain of that era

In the 1940s, Jehovah's Witnesses weren't just unpopular and marginalized. They were seen as criminal and a threat to democracy. It was blasphemous enough that they preached there was no hell or trinity and went knocking on doors to say so. But they also refused to salute the flag or say the Pledge of Allegiance.

Lillian Gobitas was among thousands of Jehovah's Witness children expelled from public school for not saluting the flag. Her case (Minersville School District v. Gobitis) went to the Supreme Court and a fundamental question was asked: Should a free society force its citizens to engage in patriotic ritual? In 1940, the court said yes. National unity was at stake.

But Jehovah's Witnesses wouldn't comply, saying the flag salute is an idolatrous act of worship of a man-made symbol, which is forbidden by God. In response, mobs attacked Jehovah's Witnesses in 44 states, burned their houses of worship and beat them. First lady Eleanor Roosevelt spoke out against the violence. At the height of World War II, when the U.S. was fighting nationalism in Germany, where Jehovah's Witnesses were being sent to concentration camps for refusing to do the Nazi salute, the Supreme Court revisited the case (West Virginia State Board of Education v. Barnette). A stunning reversal was announced June 14, 1943 — Flag Day.

In 2010, the value Judge Walker saw in the Jehovah's Witness case was how Justice Robert Jackson in 1943 addressed the "tyranny of the majority," a problem that's been around since at least 1835 when Alexis de Tocqueville first wrote the phrase in his book, Democracy in America.

The 1940 Supreme Court used "national unity" to justify forcing kids to salute the flag. It also said the threat of being expelled from school was a good way to achieve compliance. If anyone felt put out, the court said, he could seek remedy at the ballot box by asking the majority to see it his way.

When Justice Jackson got the chance to reverse the 1940 ruling, he tackled the ballot box notion head-on. He wrote that the "very purpose" of the Bill of Rights was to protect some issues from the volatility of politics and "place them beyond the reach of majorities."

"One's right to life, liberty and property, to free speech, a free press, freedom of worship and assembly," Jackson said, "may not be submitted to vote."

Rights trump elections

Judge Walker used Jackson's line in striking down the 52% majority vote that had taken away the fundamental right of gay and lesbian couples to marry in California.

While we can thank Jehovah's Witnesses for this precedent that aims to prevent tyranny of the majority, it should be noted they don't like gay marriage. They consider it sin and aren't afraid to say so. But not one devoted Jehovah's Witness voted for or supported Prop 8. Jehovah's Witnesses are apolitical. Rather than forcing their beliefs through legislation, they prefer to find converts by sharing a message.

Justice Jackson saw how protecting the rights of an unpopular religion demonstrated the beauty and full potential of the Bill of Rights for every unpopular group to follow.

"Fundamental rights," Jackson wrote in 1943 and Judge Walker quoted in 2010, "depend on the outcome of no elections."

Welcome to a rational response to an invalid, but highly charged issue- gay marriage.

2 years ago, the US voted in the first Black American President even as the state of California voted against gay marriage rights.
Does this pose a logic problem to you?
Of course- it seems 'incongruous'.

The reality was that the state of California- a liberal state that promotes equality, same sex rights, free speech, and has huge populations of gay Americans, was inundated with money and slanted, scary advertising before the vote- all of it aimed at making gay Californians appear to be dangerous people with strange *agendas* that were geared at:

Turning kindergarten children into homosexuals.
Taking away the rights of straight couples.
Promoting gay rights at the exspense of Blacks and Hispanics.
Draining the state budget with excessive regulations.
Mocking the Church.
Making straight couples feel that their marriages were crappy if gay people got one too.
Using God's wraith and possible destruction of the state to scare people into voting Yes on 8.
A host of threats based around ideas associated with talking gerbils eating babies while their parents slept.
Armageddon.
Pedophilia being made legal.
People marrying their pets.
Public masturbation.
Hate.

This funding was later found tied directly to the Mormon Church (Utah), and violated our State and Federal laws about tinkering with the elective process by using money to flood any elective process with lies and scary threats. The Catholic churches jumped on the bandwagon, knowing that fear brings in money to those church offering baskets. Misinformation, and an electorate that is increasingly using the media pundits to learn about complicated issues in 15 second sound bites, further eroded the natural state process and created an environment where fear and loathing were considered 'acceptable' reasons to deny someone their rights.

Today, we have a judge deciding that the vote was illegal. That vote, and the entire proposition, are illegal because they were written to deny valid rights to a segment of our population.

Now, we have those pesky far-right, uber conservative whiners screaming about ' activist judges overturning the people's will'.

Well of COURSE the judges are going to overturn the will of the people when the people vote stupid.

Voting to overturn basic human rights violates our underlying constitutional tenants.
We CREATED those CONSTITUTIONAL foundations so that people cannot do stupid things.
Now, these same far right blow holes scream all the time about the need to be conservative and CONSTITUTIONAL. Usually, they do so when they think they can deny someone else their rights.

So- if you have ANY complaints about a judge saying that voting to deny people their rights is wrong, let me tell you a couple of OTHER things.

Should anyone manage to manipulate or buy a vote in any state to allow adults to eat newborn babies as treats, activist judges will over turn that ruling. It doesn't matter how good they taste, or how many adults WANT to eat the babies, or WHY they want to, of if their GOD told them to or not. You cannot eat babies, you cannot legislate to eat babies, and you cannot create propositions and lie to people and make them think that they can vote in laws to eat babies.

Should anyone manage to manipulate or buy a vote in any state to allow white people to shoot black people, activist judges will over turn that ruling. It doesn't matter how good a shot you are, or how many white people WANT to shoot black people , or WHY they want to, of if their GOD told them to or not. You cannot shoot black people, you cannot legislate to shoot black people , and you cannot create propositions and lie to people and make them think that they can vote in laws to shoot black people.

Should anyone manage to manipulate or buy a vote in any state to allow Christians to rule the world with the bible and ignore the rights of Muslims, Jews, Buddhists, Heathens, and Democrats, activist judges will over turn that ruling. It doesn't matter how wonderful you think your rule will be, or how many other Christians think it's a good idea, or WHY you want to do it, or if you think GOD told you or NOT! You CANNOT take over and allow Christians to rule the world with the bible and ignore the rights of Muslims, Jews, Buddists, Heathens, and Democrats.

Now... can you see that this is not about activism? It is about following the constitutional idea that no group of people can vote themselves rights that they won't share with everyone, allow some people to do something but not others, or use their religious feelings to beat up on those that don't agree with them.

Ruling against Prop. 8 could lead to federal precedent on gay marriage

Judge says the same-sex marriage ban was rooted in 'moral disapproval' and violates constitutional rights to equal protection and due process. Opponents vow to appeal all the way to the Supreme Court.

A federal judge declared California's ban on same-sex marriage unconstitutional Wednesday, saying that no legitimate state interest justified treating gay and lesbian couples differently from others and that "moral disapproval" was not enough to save the voter-passed Proposition 8.

(The key word here is legitimate. There is no legal way to justify using biblical phrases as a basis to deny rights).

California "has no interest in differentiating between same-sex and opposite-sex unions," U.S. District Chief Judge Vaughn R. Walker said in his 136-page ruling.

The ruling was the first in the country to strike down a marriage ban on federal constitutional grounds. Previous cases have cited state constitutions.

Lawyers on both sides expect the ruling to be appealed and ultimately reach the U.S. Supreme Court during the next few years.

It is unclear whether California will conduct any same-sex weddings during that time. Walker stayed his ruling at least until Friday, when he will hold another hearing.

In striking down Proposition 8, Walker said the ban violated the federal constitutional guarantees of equal protection and of due process.

Previous court decisions have established that the ability to marry is a fundamental right that cannot be denied to people without a compelling rationale, Walker said. Proposition 8 violated that right and discriminated on the basis of both sex and sexual orientation in violation of the equal protection clause, he ruled.

(Fundamental right is what we in the world call 'equality'. Disliking men who kiss other men is not a basis to deny equality. Fearing God or any other irrational belief in fantasy figures, imaginary friends, or Flying Spaghetti Monsters is not either).

The jurist, a Republican appointee who is gay, cited extensive evidence from the trial to support his finding that there was not a rational basis for excluding gays and lesbians from marriage. In particular, he rejected the argument advanced by supporters of Proposition 8 that children of opposite-sex couples fare better than children of same-sex couples, saying that expert testimony in the trial provided no support for that argument.

(There have been thousands of studies in the last 30 years that show NO difference- which is why, although the supporters of the ban argued this way, they could not come up with any valid studies. All valid studies support the gay parents, not the biblical whiners.)

"The evidence shows conclusively that moral and religious views form the only basis for a belief that same-sex couples are different from opposite-sex couples," Walker wrote.

Andy Pugno, a lawyer for the backers of the ballot measure, said he believed Walker would be overturned on appeal.

Walker's "invalidation of the votes of over 7 million Californians violates binding legal precedent and short-circuits the democratic process," Pugno said.

(No, it doesn't. It does not matter if 7 million or 7 BILLION people vote to deny just 1 person their rights- it's still unconstitutional!)

He called it "disturbing that the trial court, in order to strike down Prop. 8, has literally accused the majority of California voters of having ill and discriminatory intent when casting their votes for Prop. 8."

(Actually, only Walker said this. What the decision implies is NOT that the majority had ill and discriminatory intent- just the backers and money people who sent thousands of misleading fliers, hundreds of misleading advertisements, and millions of pressurized and illegal phone calls to voters to scare them and make them think they were voting Yes on gay marriage when they were voting NO to it.

More importantly, it doesn't MATTER if they have ill and discriminatory intent. It doesn't MATTER if a judge SAYS that or not. What matters is that we, as a civilized people, do NOT refuse the minority their legal rights to equality under the laws.)

At least some legal experts said his lengthy recitation of the testimony could bolster his ruling during the appeals to come. Higher courts generally defer to trial judges' rulings on factual questions that stem from a trial, although they still could determine that he was wrong on the law.

John Eastman, a conservative scholar who supported Proposition 8, said Walker's analysis and detailed references to trial evidence were likely to persuade U.S. Supreme Court Justice Anthony M. Kennedy, a swing vote on the high court, to rule in favor of same-sex marriage.

"I think Justice Kennedy is going to side with Judge Walker," said the former dean of Chapman University law school.

Barry McDonald, a constitutional law professor at Pepperdine University, said Walker's findings that homosexuality is a biological status instead of a voluntary choice, that children don't suffer harm when raised by same-sex couples and that Proposition 8 was based primarily on irrational fear of homosexuality "are going to make it more difficult for appellate courts to overturn this court's ruling."

Edward E. (Ned) Dolejsi, executive director of the California Catholic Conference, said he believed the judge's ruling was both legally and morally wrong.

"All public law and public policy is developed from some moral perspective, the morality that society judges is important," he said. To say that society shouldn't base its laws on moral views is "hard to even comprehend," he said.

(Actually, the majority of our laws are based on keeping the peace, not some moral imperative. Morality is subjective, and changes from person to person, situation to situation. Our laws are based on fair and equal value- not what one group considers 'moral' at the expense of anyone else. )

In his decision, Walker said the evidence showed that "domestic partnerships exist solely to differentiate same-sex unions from marriage" and that marriage is "culturally superior."

He called the exclusion of same-couples from marriage "an artifact of a time when the genders were seen as having distinct roles in society and marriage."

"That time has passed," he wrote.

Although sexual orientation deserves the constitutional protection given to race and gender, Proposition 8 would be unconstitutional even if gays and lesbians were afforded a lesser status, Walker said. His ruling stressed that there was no rational justification for banning gays from marriage.

To win a permanent stay pending appeal, Proposition 8 proponents must show that they are likely to prevail in the long run and that there would be irreparable harm if the ban is not enforced.

Lawyers for the two couples who challenged Proposition 8 said they were confident that higher courts would uphold Walker's ruling.

"We will fight hard so that the constitutional rights vindicated by the 138-page, very careful, thoughtful, analytical opinion by this judge will be brought into fruition as soon as possible," pledged Ted Olson, one of the lawyers in the case.

Other gay rights lawyers predicted that the ruling would change the tenor of the legal debate in the courts.

"This is a tour de force — a grand slam on every count," said Shannon Price Minter, legal director for the National Center for Lesbian Rights. "This is without a doubt a game-changing ruling."

Wednesday's ruling stemmed from a lawsuit filed last year by two homosexual couples who argued that the marriage ban violates their federal constitutional rights to equal protection and due process.

The suit was the brainchild of a gay political strategist in Los Angeles who formed a nonprofit to finance the litigation.

The group hired two legal luminaries from opposite sides of the political spectrum to try to overturn the ballot measure. Former U.S. Solicitor General Theodore B. Olson, a conservative icon, signed on with litigator David Boies, a liberal who squared off against Olson in Bush vs. Gore, the U.S. Supreme Court ruling that gave George W. Bush the presidency in 2000.

Gay-rights groups had opposed the lawsuit, fearful that the U.S. Supreme Court might rule against marriage rights and create a precedent that could take decades to overturn.

But after the suit was filed, gay rights lawyers flocked to support it, filing friend-of-court arguments on why Proposition 8 should be overturned.

Gov. Arnold Schwarzenegger and Atty. Gen. Jerry Brown refused to defend the marriage ban, leaving the sponsors of the initiative to fill the vacuum. They hired a team of lawyers experienced in U.S. Supreme Court litigation.

Proposition 8 passed with a 52.3% vote six months after the California Supreme Court ruled that same-sex marriage was permitted under the state Constitution.

At trial, the opponents of Prop. 8 presented witnesses who cited studies that showed children reared from birth by gay and lesbian couples do as well as children born into opposite-sex families. They also testified that the clamor for marriage in the gay community had given the institution of marriage greater esteem.

The trial appeared to be a lopsided show for the challengers, who called 16 witnesses, including researchers from the nation's top universities, and presented tearful testimony from gays and lesbians about why marriage mattered to them.

The backers of Proposition 8 called only two witnesses, and both made concessions under cross-examination that helped the other side.

The sponsors complained that Walker's pretrial rulings had been unfair and that some of their prospective witnesses decided not to testify out of fear for their safety.

When Walker ruled that he would broadcast portions of the trial on the Internet, Proposition 8 proponents fought him all the way to the U.S. Supreme Court and won a 5-4 ruling barring cameras in the courtroom.

The trial nevertheless was widely covered, with some groups doing minute-by-minute blogging. Law professors brought their students to watch the top-notch legal theater.

An estimated 18,000 same-sex couples married in California during the months it was legal, and the state continues to recognize those marriages.

One night, in Meiwes’s farmhouse, Brandes took some sleeping pills and drank some schnapps and was still awake when Meiwes cut off his penis, fried it in olive oil and offered him some to eat. Brandes then retreated to the bathtub, bleeding profusely. Meiwes stabbed him in the neck, chopped him up and stored him in the freezer. Over the next several weeks, he defrosted and sautéed 44 pounds of Brandes, eating him by candlelight with his best cutlery.

The New Science of Why We Like What We Like

Hold on a minute. Why does this story appear in “How Pleasure Works,” a book whose jacket copy promises a “new understanding of pleasure, desire and value”? If this is a “new understanding,” maybe we’ll just stick with the old one, thank you very much. For heaven’s sake, we’re only on Chapter 2, and already we’re deep into cannibalism, compounded by a suicidal-masochistic impulse. Still to come are such topics as rubber vomit, human grimacing contests and monkey pornography.

But stick with it and trust the author, Paul Bloom, to use these weird digressions to get us someplace interesting. Bloom, a professor of psychology at Yale, has written a book that is different from the slew already out there on the general subject of happiness. No advice here about how to become happier by organizing your closets; Bloom is after something deeper than the mere stuff of feeling good. He analyzes how our minds have evolved certain cognitive tricks that help us negotiate the physical and social world — and how those tricks lead us to derive pleasure in some rather unexpected places.

“Many significant human pleasures are universal,” Bloom writes. “But they are not biological adaptations. They are byproducts of mental systems that have evolved for other purposes.” Evolutionary psychologists like Bloom are fond of explaining perplexing psychological attributes this way. These traits emerged, the argument goes, as accidental accompaniments to other traits that help us survive and reproduce.

Our most puzzling sources of pleasure, according to this view, are side effects of our inborn “essentialism,” the idea that “things have an underlying reality or true nature . . . and it is this hidden nature that really matters.” It was to our ancestors’ advantage to be essentialists, so they could categorize the plants and animals in their environment into “dangerous” and “harmless” and thereby know which ones to avoid. Today, our ability to recognize the essence of things explains, for instance, why someone would be willing to pay $48,875 for a tape measure once owned by John F. Kennedy.

Pornography is another example of pleasure via essentialism. Why do some men spend more time looking at Internet porn than interacting with flesh-and-blood lovers? There may be “no reproductive advantage” to liking pornography, Bloom writes, but there is an advantage to its source: an urge to look at real-world “attractive naked people,” which makes us want sex, which in turn is good for continuation of the species. Pornography uses the same pleasure mechanism as actual sex, which is handy since “there aren’t always attractive naked people around when you need them.”

Then there are the (sometimes) more G-rated pleasures of the imagination: the joys of fiction, movies, television, daydreaming. “Surely we would be better off pursuing more adaptive activities — eating and drinking and fornicating, establishing relationships, building shelter and teaching our children,” Bloom writes. But when we retreat into an imagined world, it’s almost like experiencing the pleasure for real. Bloom calls it “Reality Lite — a useful substitute when the real pleasure is inaccessible, too risky or too much work.”

Bloom’s ideas go against the traditional view of pleasure as purely sensory: that is, that we get pleasure from food because of how it tastes, from music because of how it sounds, from art because of how it looks. The sensory explanation is only partially true, he writes. “Pleasure is affected by deeper factors, including what the person thinks about the true essence of what he or she is getting pleasure from.” When we pay good money for tape measures that famous people have touched, or treasure our children’s clumsy kindergarten art, it is because we believe that something about the person’s essence exists in the object itself. How else to explain Jonathan Safran Foer’s collection of blank sheets of paper? These are not just any blank sheets: they are the sheets that were about to be written on next by Paul Auster, Susan Sontag and David Foster Wallace, who sent them to Foer at his request.

And what about the seamier sides of pleasure, like the performance artist who sold 90 cans of his own feces, half of which were improperly autoclaved and would eventually explode, for as much as $61,000 a can? Bloom writes about them without judgment; they just help prove his point, albeit in some grotesque ways. Remember the cannibal Armin Meiwes and his victim, Bernd Brandes? Meiwes believed he was eating Brandes’s essence. “With every bite, my memory of him grew stronger,” Meiwes told the authorities. He also noted that Brandes had been fluent in English — and that since eating him, his own English had much improved.

Remember, get a breast exam and MAMMOGRAM EVERY YEAR from age 30 on- no matter what current *insurance* companies say (their numbers are predicated on the cost analysis basis of losing a few of us at the young and old end of the spectrums), we are at risk from cancer here- not something you can feel until it is VERY late in the game.

A 15% reduction in deaths of women age 40-49 is not warranted?"

An open letter to conservatives

Dear Conservative Americans,

The years have not been kind to you. I grew up in a profoundly Republican home, so I can remember when you wore a very different face than the one we see now. You've lost me and you've lost most of America. Because I believe having responsible choices is important to democracy, I'd like to give you some advice and an invitation.

First, the invitation: Come back to us.

Now the advice. You're going to have to come up with a platform that isn't built on a foundation of cowardice: fear of people with colors, religions, cultures and sex lives that differ from your own; fear of reform in banking, health care, energy; fantasy fears of America being transformed into an Islamic nation, into social/commun/fasc-ism, into a disarmed populace put in internment camps; and more. But you have work to do even before you take on that task.

Your party -- the GOP -- and the conservative end of the American political spectrum have become irresponsible and irrational. Worse, it's tolerating, promoting and celebrating prejudice and hatred. Let me provide some examples -- by no means an exhaustive list -- of where the Right as gotten itself stuck in a swamp of hypocrisy, hyperbole, historical inaccuracy and hatred.

If you're going to regain your stature as a party of rational, responsible people, you'll have to start by draining this swamp:

Hypocrisy

You can't flip out -- and threaten impeachment - when Dems use a parliamentary procedure (deem and pass) that you used repeatedly (more than 35 times in just one session and more than 100 times in all!), that's centuries old and which the courts have supported. Especially when your leaders admit it all.

You can't vote and scream against the stimulus package and then take credit for the good it's done in your own district (happily handing out enormous checks representing money that you voted against, is especially ugly) -- 114 of you (at last count) did just that -- and it's even worse when you secretly beg for more.

You can't fight against your own ideas just because the Dem president endorses your proposal.

You can't call for a pay-as-you-go policy, and then vote against your own ideas.

Are they "unlawful enemy combatants" or are they "prisoners of war" at Gitmo? You can't have it both ways.

You can't carry on about the evils of government spending when your family has accepted more than a quarter-million dollars in government handouts.

You can't refuse to go to a scheduled meeting, to which you were invited, and then blame the Dems because they didn't meet with you.

You can't rail against using teleprompters while using teleprompters. Repeatedly.

You can't rail against the bank bailouts when you supported them as they were happening.

You can't be for immigration reform, then against it .

You can't enjoy socialized medicine while condemning it.

You can't flip out when the black president puts his feet on the presidential desk when you were silent about white presidents doing the same. Bush. Ford.

You can't complain that the president hasn't closed Gitmo yet when you've campaigned to keep Gitmo open.

You can't flip out when the black president bows to foreign dignitaries, as appropriate for their culture, when you were silent when the white presidents did the same. Bush. Nixon. Ike. You didn't even make a peep when Bush held hands and kissed (on the mouth) leaders of countries that are not on "kissing terms" with the US.

You can't complain that the undies bomber was read his Miranda rights under Obama when the shoe bomber was read his Miranda rights under Bush and you remained silent. (And, no, Newt -- the shoe bomber was not a US citizen either, so there is no difference.)

You can't attack the Dem president for not personally* publicly condemning a terrorist event for 72 hours when you said nothing about the Rep president waiting 6 days in an eerily similar incident (and, even then, he didn't issue any condemnation). *Obama administration did the day of the event.

You can't throw a hissy fit, sound alarms and cry that Obama freed Gitmo prisoners who later helped plan the Christmas Day undie bombing, when -- in fact -- only one former Gitmo detainee, released by Dick Cheney and George W. Bush, helped to plan the failed attack.

You can't condemn blaming the Republican president for an attempted terror attack on his watch, then blame the Dem president for an attempted terror attack on his.

You can't mount a boycott against singers who say they're ashamed of the president for starting a war, but remain silent when another singer says he's ashamed of the president and falsely calls him a Maoist who makes him want to throw up and says he ought to be in jail.

You can't cry that the health care bill is too long, then cry that it's too short.

You can't support the individual mandate for health insurance, then call it unconstitutional when Dems propose it and campaign against your own ideas.

You can't demand television coverage, then whine about it when you get it. Repeatedly.

You can't praise criminal trials in US courts for terror suspects under a Rep president, then call it "treasonous" under a Dem president.

You can't propose ideas to create jobs, and then work against them when the Dems put your ideas in a bill.

You can't be both pro-choice and anti-choice.

You can't damn someone for failing to pay $900 in taxes when you've paid nearly $20,000 in IRS fines.

You can't condemn criticizing the president when US troops are in harms way, then attack the president when US troops are in harms way , the only difference being the president's party affiliation (and, by the way, armed conflict does NOT remove our right and our duty as Americans to speak up).

You can't be both for cap-and-trade policy and against it.

You can't vote to block debate on a bill, then bemoan the lack of 'open debate'.

If you push anti-gay legislation and make anti-gay speeches, you should probably take a pass on having gay sex, regardless of whether it's 2004 or 2010. This is true, too, if you're taking GOP money and giving anti-gay rants on CNN. Taking right-wing money and GOP favors to write anti-gay stories for news sites while working as a gay prostitute, doubles down on both the hypocrisy and the prostitution. This is especially true if you claim your anti-gay stand is God's stand, too.

When you chair the House Caucus on Missing and Exploited Children, you can't send sexy emails to 16-year-old boys (illegal anyway, but you made it hypocritical as well).

You can't criticize Dems for not doing something you didn't do while you held power over the past 16 years, especially when the Dems have done more in one year than you did in 16.

You can't decry "name calling" when you've been the most consistent and outrageous at it. And the most vile.

You can't spend more than 40 years hating, cutting and trying to kill Medicare, and then pretend to be the defenders of Medicare

You can't praise the Congressional Budget Office when it's analysis produces numbers that fit your political agenda, then claim it's unreliable when it comes up with numbers that don't.

You can't vote for X under a Republican president, then vote against X under a Democratic president. Either you support X or you don't. And it makes it worse when you change your position merely for the sake obstructionism.

You can't call a reconciliation out of bounds when you used it repeatedly.

You can't spend taxpayer money on ads against spending taxpayer money.

You can't condemn individual health insurance mandates in a Dem bill, when the mandates were your idea.

You can't demand everyone listen to the generals when they say what fits your agenda, and then ignore them when they don't.

You can't whine that it's unfair when people accuse you of exploiting racism for political gain, when your party's former leader admits you've been doing it for decades.

You can't portray yourself as fighting terrorists when you openly and passionately support terrorists.

You can't complain about a lack of bipartisanship when you've routinely obstructed for the sake of political gain -- threatening to filibuster at least 100 pieces of legislation in one session, far more than any other since the procedural tactic was invented -- and admitted it. Some admissions are unintentional, others are made proudly. This is especially true when the bill is the result of decades of compromise between the two parties and is filled with your own ideas.

You can't question the loyalty of Department of Justice lawyers when you didn't object when your own Republican president appointed them.

You can't preach and try to legislate "Family Values" when you: take nude hot tub dips with teenagers (and pay them hush money); cheat on your wife with a secret lover and lie about it to the world; cheat with a staffer's wife (and pay them off with a new job); pay hookers for sex while wearing a diaper and cheating on your wife; or just enjoying an old fashioned non-kinky cheating on your wife; try to have gay sex in a public toilet; authorize the rape of children in Iraqi prisons to coerce their parents into providing information; seek, look at or have sex with children; replace a guy who cheats on his wife with a guy who cheats on his pregnant wife with his wife's mother;

Hyperbole

You really need to disassociate with those among you who:

assert that people making a quarter-million dollars a year can barely make ends meet or that $1 million "isn't a lot of money";
say that "Comrade" Obama is a "Bolshevik" who is "taking cues from Lenin";
ignore the many times your buddies use a term that offends you and complain only when a Dem says it;
liken political opponents to murderers, rapists, and "this Muslim guy" that "offed his wife's head" or call then "un-American";
say Obama "wants his plan to fail...so that he can make the case for bank nationalization and vindicate his dream of a socialist economy";
equate putting the good of the people ahead of your personal fortunes with terrorism;
smear an entire major religion with the actions of a few fanatics;
say that the president wants to "annihilate us";
compare health care reform with the bombing of Pearl Harbor, a Bolshevik plot the attack on 9/11,or reviving the ghosts of communist dictators (update: it's also not Armageddon);
equate our disease-fighting stem cell research with "what the Nazis did";
call a bill passed by the majority of both houses of Congress, by members of Congress each elected by a majority in their districts, an unconscionable abuse of power, a violation of the presidential oath or "the end of representative government";
shout "baby killer" at a member of Congress on the floor of the House, especially one who so fought against abortion rights that he nearly killed health care reform (in fact, a little decorum, a little respect for our national institutions and the people and the values they represent, would be refreshing -- cut out the shouting, the swearing and the obscenities);
prove your machismo by claiming your going to "crash a party" to which you're officially invited;
claim that Obama is pushing America's "submission to Shariah";
question the patriotism of people upholding cherished American values and the rule of law;
claim the president is making us less safe without a hint of evidence;
call a majority vote the "tyranny of the minority," even if you meant to call it tyranny of the majority -- it's democracy, not tyranny;
call the president's support of a criminal trial for a terror suspect "treasonous" (especially when you supported the same thing when the president shared your party);
call the Pope the anti-Christ;
assert that the constitutionally mandated census is an attempt to enslave us;
accuse opponents of being backed by Arab slave-drivers or of being drunk and suicidal;
equate family planning with eugenics or Nazism;
accuse the president of changing the missile defense program's logo to match his campaign logo and reflect what you say is his secret Muslim identity;
accuse political opponents of being totalitarians, socialists, communists, fascists, Marxists; terrorist sympathizers, McCarthy-like, Nazis or drug pushers; and
advocate a traitorous act like secession, violent revolution , military coup or civil war (just so we're clear: sedition is a bad thing).

History

If you're going to use words like socialism, communism and fascism, you must have at least a basic understanding of what those words mean (hint: they're NOT synonymous!)

You can't cut a leading Founding Father out the history books because you've decided you don't like his ideas.

You cant repeatedly assert that the president refuses to say the word "terrorism" or say we're at war with terror when we have an awful lot of videotape showing him repeatedly assailing terrorism and using those exact words.

If you're going to invoke the names of historical figures, it does not serve you well to whitewash them. Especially this one.

You can't just pretend historical events didn't happen in an effort to make a political opponent look dishonest or to make your side look better. Especially these events. (And, no, repeating it doesn't make it better.)

You can't say things that are simply and demonstrably false: health care reform will not push people out of their private insurance and into a government-run program ; health care reform (which contains a good many of your ideas and very few from the Left) is a long way from "socialist utopia"; health care reform is not "reparations"; nor does health care reform create "death panels".

Hatred

You have to condemn those among you who:

call members of Congress n*gger and f*ggot;
elected leaders who say "I'm a proud racist";
state that America has been built by white people;
say that poor people are poor because they're rotten people, call them "parasitic garbage" or say they shouldn't be allowed to vote;
call women bitches and prostitutes just because you don't like their politics ( re - pea -ted - ly );
assert that the women who are serving our nation in uniform are hookers;
mock and celebrate the death of a grandmother because you disagree with her son's politics;
declare that those who disagree with you are shown by that disagreement to be not just "Marxist radicals" but also monsters and a deadly disease killing the nation (this would fit in the hyperbole and history categories, too);
joke about blindness;
advocate euthanizing the wife of your political opponent;
taunt people with incurable, life-threatening diseases -- especially if you do it on a syndicated broadcast;
equate gay love with bestiality -- involving horses or dogs or turtles or ducks -- or polygamy, child molestation, pedophilia;
casually assume that only white males look "like a real American";
assert presidential power to authorize torture, torture a child by having his testicles crushed in front of his parents to get them to talk, order the massacre of a civilian village and launch a nuclear attack without the consent of Congress;
attack children whose mothers have died;
call people racists without producing a shred of evidence that they've said or done something that would even smell like racism -- same for invoking racially charged "dog whistle" words (repeatedly);
condemn the one thing that every major religion agrees on;
complain that we no longer employ the tactics we once used to disenfranchise millions of Americans because of their race;
blame the victims of natural disasters and terrorist attacks for their suffering and losses;
celebrate violence , joke about violence, prepare for violence or use violent imagery, "fun" political violence, hints of violence, threats of violence (this one is rather explicit), suggestions of violence or actual violence (and, really, suggesting anal rape with a hot piece of metal is beyond the pale); and
incite insurrection telling people to get their guns ready for a "bloody battle" with the president of the United States.

Oh, and I'm not alone: One of your most respected and decorated leaders agrees with me.

So, dear conservatives, get to work. Drain the swamp of the conspiracy nuts, the bold-faced liars undeterred by demonstrable facts, the overt hypocrisy and the hatred. Then offer us a calm, responsible, grownup agenda based on your values and your vision for America. We may or may not agree with your values and vision, but we'll certainly welcome you back to the American mainstream with open arms. We need you.

Age of Onset

The question of when kinky people became kinky (or first noticed they were kinky) is a complicated one. Adults might mis-remember the development of their sexuality, or retroactively identify things in ways that are different from the understandings they had at the time. Some people seem to become partially aware of kinky desires, but attempt to minimize their significance, or even actively combat that aspect of their personality.

Researchers have approached this question using a range of lenses, and the answers vary accordingly. In general, it seems that a fairly large group of kinky people become aware of themselves as kinky at or before adolescence. This point was noted in a case study by Krafft-Ebing a century ago (p. 99):

“my masochistic ideas were manifested from my earliest youth, and that, as long as I have been capable of thinking, I have had such thoughts.”

The DSM-IV maintains that sadism and masochism are typically present from a young age. However, questions like when someone “came out” or had the first experience that they identified as sadomasochistic tend to elicit later responses, with a mean age in the early 20s. There is also a general suggestion in most of these authors that people realize themselves to be heterosexual, bisexual, or homosexual earlier than they realize they are kinky.

We Deserve A Break from McDonalds

Dear McDonalds:

I have been a customer my whole life, and have watched a lot of changes happen in the way the corporation handles the business end of making and selling hamburgers to Americans.

Lately, I have run into some problems, and wanted to share them with you.
You do NOT have a very 'user friendly" system for registering complaints, and those that you do get seem to fall on deaf ears, so I thought I would bring them here.

Today, I went to get a Mighty Kids Meal for my son.
He hates cheese on his burgers, and so I ordered a Mighty Kids Hamburger meal, Sprite, Boy Toy.

Simple hu?
OH NOOOOOOOOOOOO.
They don't understand that at ANY of my local McDonalds, since they, like ALL your stores, are FRANCHISES run by mental midgets.
At MY McDonalds, I get the voice asking me if I want "A drink with that Happy Meal?".

Me: "That's not a happy meal. I want the mighty kids meal hamburger"
Voice: "That's a happy meal."
Me: "No, a happy meal has one patty of meat and a mighty kids meal has two".
Voice: "Oh, You want the mighty kids cheeseburger, what will you have to drink with that?"
Me: "NO! MY SON HATES CHEESE. I want that as a double hamburger".
Voice: "Yes, I can get you a double cheeseburger meal. Did You want to supersize that?"
Me: "I want that as a kids meal".
Voice: "The happy meal. Do you want a boy toy?"
Me: " The Mighty Kids Meal!!!!"
Voice: " That only comes as cheeseburger or chicken nuggets".

Now at this point I am tempted to order the Mighty Kids nugget meal without cheese and two patties just to see if their heads explode. MINE already HAS.
I go through this for SEVERAL more rounds, and eventually get through (so I think) and drive forward.

I get to the window, and get handed several bags (we had 3 orders total, the other 2 were simple as well, but did not require a map and shiny arrows). I open the bags, and we have our 2 burgers correct. There is a 3d bag with 2 burritos we did not order, which I pull to the side to give back in a moment. Then, there is the bag with the Mighty Kids Meal.
It has a single hamburger patty.

Foolishly, I think in my head "OK, Give this back to them, tell them they have made a mistake and that you want the right burger".
I do that. The hispanic store manager at the window looks at it and says "Yes, that's a hamburger".
Me: "Yes, it is. I ordered the Mighty Kids meal, not the happy meal."
Manager: "No, you ordered the happy meal".
Me: "No, I want TWO hamburger patties".
Manager: "That's a double hamburger not a happy meal".
Me: "I wanted a Mighty kids meal".
Manager: "You did not order that, you ordered a happy meal".
Me: "No I did not".
Manager looks at the receipt and points out the print.
Manager: "You ordered a happy meal".
Me: "No, I ordered a Mighty kids meal hamburger. What's the difference"- thinking that since it showed I PAID for a Happy meal that I will owe them money for the Mighty Kids Meal when I eventually get the double hamburger.
The manager does not understand this, as his English is not very good.
Manager: "The difference is that one has just one patty".

Manager: "You ordered the happy meal, and it doesn't have the double hamburger. The Mighty kids meal is a double cheeseburger".
Me: (Now angry enough that I am ready to do something unladylike) "I WANTED A DOUBLE HAMBURGER MIGHTY KIDS MEAL - DON'T YOU IDIOTS SELL THAT ANYMORE?"
Manager: Hands me a double hamburger saying "We sell hamburgers and double cheeseburgers".
Me, taking the double hamburger, notices that we still have the single in the car.
Manager: "That costs another 48 cents".
Me: "Here's the difference in what I paid. Thank you".

I then took the item I WANTED, the item they gave me that I didn't want, and the bag with the 2 burritos and drove off.
Mad again.

HOW IN THE HELL CAN THEY OPERATE A BUSINESS THAT WAY????
Aren't you, the corporation, embarrassed at ALL by franchise's that have owners who hire idiots and people that cannot communicate with the customers?
Doesn't McDonalds have ANY QUALITY ASSURANCE or CUSTOMER INTERACTION STANDARDS?????????

This is not the first time I have had trouble at that store. Or the 3d. Or even the 20th.
Ever since it opened, that store has been run by staff that are just a chromosome shy of sentience. The managers are pleasant illiterates that are not aware of anything other than pictures on the keyboards and tend to drag their knuckles when they walk.

They move slowly at this McDonalds, no matter what time of day or how busy they are.
They hire people that slur their words and speak in half sentences to run the drive through windows.
The store keeps a level of service just under that offered by Turkish prisons.
There are smart cars smarter than these employees.
There are smartees CANDIES smarter than these employees.

This store could not pass gas let alone a full customer service and quality investigation.
I DARE corporate to send in undercover shoppers to focus on this place for just 10 days straight, 3 orders a day.
I guarantee you that ordering anything not EXPLICITLY PRINTED EXACTLY ON THE MENU will put the entire store into a tizzy of lack of concern and obtuse failure to comprehend on par with Custer heading into the Little Big Horn.
There are pet guinea pigs that could assist customers and generate more complete an accurate order delivery.
There are PLENTY of applicants for jobs that both speak English and walk and chew gum at the same time, yet this store finds it necessary to hire STUPID people.
I have had friends THROW food through the drive up windows over these kinds of misunderstandings. For YEARS.

So, in closing, dear McDonalds, you have a disfunctional store.
Probably more than one, but this one stands out head and shoulders above any other McDonalds I have ever been through, and I have been through almost every store in the greater bay area at one time or another during quests for Beenie Babies and Hot Wheels. There is no level of incompetence lower than this store, the McDonalds Midtown San Jose on Meridian at West San Carlos.
During these stressful times with such a low economy, taking the internal camera tapes of this and many other stupid moments and showing them on America's Funniest Videos would be a service to the world.
We need the laughter, and no one laughs harder than when they are laughing at incompetence.
This McDonalds could well herniate most of America with laughter.

The initial vote in California last November 8th, 2008, was a lie, a sham, and a farse. Voters in California are notorious for their liberal, well educated voting policies and views- when they are aware of an issue and believe it to be important.

Last year's Presidential elections were important. A nation's future hung in the balance, and we in California were no less worried that the incompetent lackluster leadership of the latter day "Know Nothing" party would drive the country past it's breaking point and leave millions on the streets and in 21st century Hoovervilles while the handful of ultra-hawks and their well paid, well trained parrots finished the rape and pillage of the American coffers, borrowing rather than taxing to pay for their own oil laden masturbatory fantasies and blaming it all on anyone who was not in power and could not defend themselves.

California was, and is, a bastion of tolerance, charity, purpose, liberty, and liberal thinking where most residents truly do not want to impose on their fellow Californian's so long as those same people don't impose upon them.
Californian's are also busy. We have lots to do, carrying the 6th largest economy on EARTH- not the US, but the EARTH, including the heart of the entertainment industry, the US wine industry, the US electronics industry and computer industry and hand held media industry and internet industry. We also contribute such varied things as Almonds, light oils, Non-industrial worked diamonds, and medical needles,catheters and parts. *
We work hard. We also play hard, and have always kept our eyes on the important issues, leading the country in reducing automobile emissions, enacting clean air and water policies, and protecting the environment.

Last November however, Californian's did not understand that a stealth movement by out of state religious zealot agitators had been afoot for months to fuel a religous earthquake with misinformation and midieval threats to a small but incredibly well organized group- the California Mormons. Their goal?
To take a minor proposition that every right thinking human in the state felt was a ridiculous pipe dream, and in the space of several weeks flood the state with messages designed to lead the weak minded to the ballot box with their brains full of mush and the fires of righteousness in their bellies.

While millions of us were working to elect the first Black President and bring some balance and a sense of intelligence back to the White House, the Mormon Church was using their TAX FREE status to influence politics in our state and deny our citizens their fair and equal rights under the guise of "separate but equal".
NO ONE in their right minds believes that separate ever means equal, from our schools in the south to medical access in the midwest to jobs to water fountains. There are haves-- and there are have nots.
We were focused on the needs to stop a war and save young American lives in Iraq instead of the machinations of a religious party who still allow their members to take multiple under age wives against their will and impregnate them in the name of God throughout the American South West.
Our historic California tolerance extended to the foibles and peculiarities of a religious cult that sprang up in the Eastern US a little over 200 years ago complete with it's own "bible" and a belief that God hates dancing and coffee. We thought they were no worse than any other sect- or, in the words of Douglas Adams, "mostly harmless".
Their mother church in the church-state of Utah however, abused the tax status of a church and violated states rights to decide their own fate and used their well attended churches to spread a noxious and vicious belief that marriage was in danger and that children would be defiled should we come to the rational, logical, reasonable, and FAIR decision to finally tear down the emotionally charged vocabulary barrier disallowing gay couples the same rights as everyone else.
It was with this comfortable belief that California was already tolerant and fair that we, the MAJORITY, the folks who do not believe in marrying TWELVE YEAR OLD GIRLS, focused on the larger issues and ignored that evil, fear soaked proposition buried on our ballots until it was too late to rally our numbers and awaken the sleeping voters to the threat towards our progressive and fair marriage rights and their march forward one hard fought victory after another.
We were, to put it sadly, asleep at the switch while the ballot box was being stuffed with lies and stretched truths, fright scenarios and defensive partisan religious fake facts.
I am not surprised that the Church of 'latter day saints' (um... no. Check with the Catholics on who is and isn't a 'Saint') got enough votes to pass this absurd twisted vote through.

With enough money and fear, in 6 months time I can convince the residents of any state in the nation to cut off their own genitals. They will do it to "save their children", to "protect and defend their country" to "stop the abominations" or to "defend their rights", but they will do it.
They will do it gladly, and they will do it as willingly as the residents of Oakland California were when they drank Kool Aid and committed suicide for the Reverend Jim Jones in Ghana, 1978, they will do it with as much surity as Yossele Schumacher's grandfather had when he kidnapped the small child from the childs parents to save his religious soul, with as much burning passion as McCarthy felt when he held the hearings on Un-American Activities, with as much damnation as the American public felt avenging the attack on Pearl Harbor, with as much blind determination as the entire inner Nazi circle had while enacting the 'final solution'.
Human nature loves to have an evil to hyper-focus on, and the religious zealots of nations throughout history have known this, and used it to their own advantage.
Sadly, the voters who DID vote for Prop 8 did not use any logic. What exactly will allowing gay couples to marry do to them?

Nothing. Not one damned thing.

There is no limit on the number of marriages that the state allows per year, so no one is going to be turned away from taking vows due to some quota being filled by happy gay couples.
Having gay people married doesn't change the quality of our air or fill up the car pool lanes any faster. Allowing our fellow Californians their RIGHT to do exactly what any one else can won't bring the wraith of God down on us- many of us not only don't believe in that God (or any God), but our *country* is built upon the belief that NO RELIGIOUS BELIEF shall over ride any other nor shall any one religion dictate the laws of the land to our citizens.
Married gay folks won't change the taste of the shrimp at Monterey Bay, won't make the sun go down any faster in the West, and won't matter a rats ass to anyone but those individual couples safe in their cocoons of love and harmony.
The religious fear mongers- and EVERY religion is full of fear mongers and those preaching hellfire and damnation to ANYONE that challenges their authority- cannot show any of us a single blessed thing that will change for the worse in recognizing marriage as a right of 2 people to enter into.
They cannot make 'unions' as legal as 'marriage', and they cannot show us proof positive that unions are not second class papers without all the legal and equitable rights that the national usage of 'marriage' instantly grants 2 people anywhere in the *world*.
Citizens of California are not demanding that anyone MUST allow marriages in their church-- that *is* for the church itself to decide, and should the righteous voters of our state continue to push the situation, I can see a time when we outlaw marriage itself, at least as a right of the church.

We can legislate that *ALL* unions must be performed at the County Clerks offices of each county to be legal and valid marriages, and whatever the individuals involved wish to do separately, without the blessings of the state, in their own churches before or afterward are their own business, but they will carry NO legal advantages or be acknowledged by any agency of the state.
Yes, you heard me right. You can get married at the clerks office, or you can have some elaborate affair at a church- but still be living in sin without the benefit of a marriage license unless you do it our way.
Yes, we CAN push that vote through.
We WILL make it right for ALL our citizens to share equally and justly in every facet of citizenship that we offer in this state.
Zealots be damned.

I read that this morning, and had a lot of what i KNOW to be right brought into a simple crystal clarity of WHY it is right.
There is nothing harder than allowing mistakes to reach the light and air, but it is the only way to become strong, honest, and respectable.
AA and the rest of the 'step' programs all have a point where ADMITTING one's errors and then correcting them if possible comes into play.
It is about showing culpability for one's actions.

THAT is a heddy thing to try to understand, and a concept that evades MOST of the people that are breathing. It makes integrity a trait that is highly admired, often bandied about, always claimed, and seldom true.

Integrity is one of those shining beacons that those who claim it for themselves immediately lose the ability to claim.... one cannot bestow it on one's self, one's family, one's own child, one's group, or one's loves. It must come from outside forces and people, as they see that it IS rather than is wanted.

Within M/s, Integrity is a deep well we drink from and those both inside and outside the M/s world would LIKE to believe that everyone entering has this trait automatically.
We do, however, know that is false. Just as any worthy and well respected undertaking will draw those with less than honorable intent to it, so does M/s.

M/s, with it's traditions dating back 60+ years to the "Old Guard" Gay males living out their Power Exchange fantasies and creating rituals that struck deep chords and touched on archetypes from the entire human spectrum, gave rise to the 21st Centuries BDSM M/s subculture and all the adherents it attracts and holds.

Some crave the stability of relationships with ritual and emotional attachment. Some crave the TPE basis of the Owner/ owned life. Some see the artifacts and relics that symbolize various aspects of M/s (the collar, the ceremony, the contract, the kneeling, the very word "slave") and crave them, weather they qualify for them or not, weather their commitments and lifestyle fit the mold they were created in or not. This "borrowing" further muddies already diluted waters and makes weighing integrity a difficult thing under the best of circumstances.

Many, both in and out of the BDSM world, find that their integrity falls the shortest when they have embarassing actions unearthed from their past. The most 'honorable' way to deal with such things is to admit the action, explain the remedial reparations that have already occurred, and apologize for the original transgression. Serious crimes and misdemeanors also require removing one's self from the situation that surrounded the crime- something many are loath to do.
Hence, we find instead a large population that would rather disagree with the fact finders about their roles in various acts, dismantle the arguments to suit their needs, and/or discredit the people who bring those transgressions up to them.

Integrity suffers and fails in those times.

We all know someone who will do ANYTHING to give the appearance of living a life of integrity, and many who have convinced themselves that they have NOT wronged someone else, to both assuage their guilt and protect their egos.

Those people are to be pitied, and kept at a safe distance. They do not understand the humility required to be a person of integrity, and they do not want to do the work required to begin their lives anew and become one. They create a cachophany that disrupts the core of any group seeking to stay on a path of honesty, faith, integrity, and respect for others that is part of the essence of WIITWD from Leather to M/s to S/m to Polyamory and beyond.

Everyone has something they hide, something they are ashamed of and do not want to deal with. Many of those things are also distant memories that have nothing to do with what we are now nor what we have created in our lives. They do not necessarily need to be dredged up meaninglessly for the sole purpose of ego enhancement. But when those issues are brought before us by others-- those usually not our friends- the only course that satisfies the need to 'keep it real' is to stand up and admit what one has done, request the opportunity for attonment, and prove sincerity for both by removing ones self from the situation or group that the lack of judgement sprang from.

I keep re-viewing the idea of integrity, and pondering the meaning of what it takes to live a life in service to others around me. It usually means following the hardest path.
